Many managers think that it is illegal to ask for sex, race, or date of birth. True,
there are a few strange state laws. However, in general, that is not the case. IT IS
ILLEGAL to use these items to discriminate in the hiring process. But, it is just as
illegal to retrieve a conviction history based on full name without checking date of
birth, race, and sex. So, complete identification data MUST be used to obtain
background information, but many of those data MUST *NOT*
be used to make the hiring decision.
